Consumer Law

Consumer law covers situations in which an individual or business has been unfairly treated or deceived. When a large number of consumers have been treated illegally in a similar fashion, consumer claims may be litigated as class actions.

A few examples of our consumer lawsuits include:

Antitrust claims against long-distance telephone companies to recover universal service charges
Claims against telephone companies for deception in billing and collecting surcharges
Price-fixing claims on behalf of purchasers of tires and rubber products
Claims against mortgage servicing company for fraud and deceptive acts

Do I really need to consult an attorney?

We highly recommend that you consult with an attorney on any legal issue. The legal system is complicated, and there are many pitfalls for those who are not thoroughly familiar with the system and know how to navigate it. There are procedural rules that every party to a lawsuit must strictly follow, and failure to follow those rules can sometimes mean losing your case. Although great strides have been made toward making courts more accessible to individual (pro se) litigants, most serious disputes require an attorney. On many occasions we have been asked to step into a case where clients have represented themselves, only to discover they have inadvertently made mistakes we cannot fix.

With that said, certain types of matters that involve small sums can often be resolved in small claims court, where attorneys are not required.
